The U.S. Senate voted today to rescind ESSA regulations related to accountability and state plans by a vote of 50-49 . The measure now will move to the President’s desk for signature. This action will not affect the ESSA amendments made to the McKinney-Vento Act’s Education for Homeless Children and Youth program, which are in statute, and are in effect now. McKinney-Vento state plans may be included within consolidated state plans. As we explained in our last newsletter, the ESSA regulations have little direct effect on McKinney-Vento implementation, because the McKinney-Vento Act itself specifies the elements that must be included within the plan.
